The Three Gateway Points Explained
The Building Safety Act 2022 has permanently altered the risk profile of UK construction. At its core sit three distinct gateway points – absolute, legal hard stops that the Building Safety Regulator (BSR) enforces across the planning, preconstruction, and pre-occupation phases:
- Gateway 1: Planning stage
- Gateway 2: Preconstruction stage
- Gateway 3: Pre-occupation stage
These regulations apply strictly to Higher-Risk Buildings (HRBs): residential buildings with at least two residential units, or care homes and hospitals, that are at least 18 metres in height or have at least seven storeys. Care homes and hospitals fall within this definition only during design and construction – once occupied, they're excluded and regulated separately under fire safety legislation.
Consequently, the disjointed building control processes of the past no longer apply to these complex developments. Developers and contractors cannot proceed past any of the gates without formal regulatory sign-off. Instead, project teams must definitively prove the design is safe before breaking ground on site, and then prove the physical structure perfectly matches that design before handing over the keys.
Gateways 1 & 2: The End of Designing While Building
For Principal Designers and Design Managers, the traditional rhythm of tendering a project and resolving design clashes on site is over. Gateway 2 introduces a rigid preconstruction barrier: teams cannot start on site until the BSR validates the entire design intent, shifting the critical milestone from design sign-off to formal regulatory approval. The statutory determination period is 12 weeks for new HRBs (eight weeks for refurbishments), though average approval times for new-build HRB applications currently run to around 22 weeks.
Once construction begins, strict change control procedures lock down site variations. Undocumented on site amendments now carry severe commercial and legal consequences. Site managers must therefore immediately distinguish between two categories of change:
Major Changes
Demand a complete halt to work and full BSR re-approval.
Notifiable Changes
Require the regulator to be informed before work proceeds, but do not require a full re-approval; teams can continue once notification has been made.
Gateway 3 & the Master Programme Reality
For Project Directors and Principal Contractors, the final hurdle is where commercial risk peaks. Gateway 3 introduces its own regulatory waiting period: the BSR has a statutory eight weeks to determine a completion certificate application. This wait disrupts traditional procurement cadences and introduces substantial holding-cost bleed. Any initial application invalidation resets the clock entirely, instantly wiping out programme buffer zones.
Furthermore, practical completion no longer equates to occupation. It is a criminal offence for residents to move in until the BSR issues a formal Completion Certificate. Given this, when determining which works require a gateway application, site directors must assume that any structural or fire safety element demands exhaustive proof of compliance, to prevent the handover sequence from stalling.
Structural Information Control via the Golden Thread
Fragmented data represents a serious commercial risk. Human effort alone cannot manage the sheer volume of spatial documentation, drawings, and cross-document compliance checks that passing Gateway 3 requires. Consequently, automated information management has become a mandatory risk-mitigation tool.
Using a centralised platform allows quality managers to maintain strict structural information control. For instance, features like Deep Document Search allow teams to query specifications and drawings in real time, isolating fire statement discrepancies across disparate files before the BSR rejects the submission. Similarly, Spec Submittal and Contract Review agents help risk managers verify information consistency, catching compliance omissions before they reach the reviewer.
